Letter to Amarillo ISD

Dear Ms. Hoxie,

 

I am writing in response to your communication to Ms. M___ B____, a member of our association.  Ms. B____ gave notice to you by phone and via certified mail of the withdrawal of her child on October 13, 2006.  Ms. B___ has received calls from you and a letter dated October 24th, in which you state, “In our last conversation, I told you that you have to withdraw A___ from school by coming to Tascosa and signing some papers.…  We cannot withdraw A____ without you personally signing withdrawal papers.  Because A_____ is still enrolled, he is missing school, and I will have to file on him through our attendance court.…  I am required by the State of Texas to request a court date because you have not properly withdrawn him.…”

 

Ms. Hoxie, according to the commissioner of education it is not necessary for parents to complete school forms if they have given written notice of withdrawal; neither is it required by law.  Ms. B____ has given written notice of the withdrawal of her child and has cooperated with your requests in the manner recommended by the TEA.  Should you or the school district pursue any legal actions against Ms. B_____ or her child on the basis of the district’s withdrawal procedures, you and/or Amarillo Independent School District may face legal liability.  Please amend the policies and/or procedures to avoid future such problems.
