THSC Association

Letter to Dunbar High School,

Ft. Worth ISD

February 26, 2007

Ms. Janae Hampton

Dunbar High School, Fort Worth ISD

5700 Ramey Ave.

Fort Worth, Texas 76112

Dear Ms. Hampton:

I am writing in response to your communication to Mr. and Mrs. R___ H____, members of our association.  On February 13, 2007, the H___s gave written notice via certified mail of the withdrawal of their child; the letter was delivered to your office on February 14.  On February 16, they received the first letter you sent asking them to come to the school and sign withdrawal forms.

The H____s responded to this inquiry by sending a letter of assurance, as described by the Texas Education Agency (TEA) in a letter from the commissioner of education dated April 20, 2004, which I have enclosed for your review.  The assurance letter was mailed via certified mail on February 19, 2007, and was delivered to your office on February 21.  On February 22, Mrs. H____ received another letter from you, stating that you had received the letter of assurance but could not withdraw their child until they came to the school and signed withdrawal forms.

Ms. Hampton, according to the commissioner of education, it is not necessary for parents to complete school forms if they have given written notice of withdrawal; neither is it required by law.  Mr. and Mrs. H____ have given written notice of the withdrawal of their child and have cooperated with your requests in the manner recommended by the TEA.  Should you or the school district pursue any legal action against Mr. and Mrs. H____ or their child on the basis of the district’s withdrawal procedures, you and/or Fort Worth Independent School District will face legal liability.

Sincerely,

Tim Lambert

Enclosure: Commissioner Letter
