Recently, a home school parent who has spoken out against the Tim Tebow bill on many occasions accused THSC and J. Shelby Sharpe, the attorney who argued the Leeper Supreme Court decision, of deceptive practices. On a Facebook post, she stated that THSC had “paid Mr. Sharpe to state his legal opinion that the Tebow Bill would not weaken the [Leeper] Judgement which defined a home school as a private school,” and that she later spoke with Mr. Sharpe who told her that the Tim Tebow bill would harm home schoolers.
Here is J. Shelby Sharpe’s reply to this individual:
“It has been published that Texas Home School Coalition has paid me for my opinion on the Tebow Bill. That is utterly false! I have expressed my opinion on this issue numerous times not just to THSC, but also to ________ without ever receiving anything of value for my opinion.
The Leeper opinion did not define a home school as a private school. The court interpreted the language in the code of a private school to include a home school. The Tebow Bill will NOT weaken the Leeper decision.
I did not tell Ms. ________ that it would be unwise to get the benefits of the Tebow Bill if it passed. I told her that if she felt the distinction between home school students and other private school students was unwise, then to lobby THSC. This did not mean and should not be interpreted that I agree with her concern.
I sincerely believe that Ms. ______ does not understand the Tebow Bill and its relationship to Leeper, which is none.”
The Leeper decision simply clarified that a home school is protected in the same way a private school is–not that they are completely identical. UPDATE: The person in question later recanted her accusatory statement and said that it was possible she misunderstood Mr. Sharpe, and had incorrectly jumped to conclusions.
