It has been truly discouraging the way in which campaign and primary elections seem to go as of recently. At one time, politics and political campaigns were about policy and deciding who would make better decisions if elected to office; however, this does not seem to be the case anymore. It seems that many campaigns spend time spreading stories about the opponent that are either untrue or have no bearing whatsoever on the election. Sometimes these kinds of attacks are made by one candidate toward the opponent, and sometimes they are even made by a candidate’s supporters toward the opponent. Regardless, it would do many people good to get all of the facts before attempting to ruin someone’s reputation. False Accusations of Supporting Sharia Law
A prime example of this are the accusations brought up about Justice Michael Massengale by Justice Debra Lehrmann’s supporters. Early on in the campaign cycle, rumors began to surface that Justice Massengale supported Sharia Law in Texas. The reasoning behind this was that Massengale was involved in Ashfaq v. Ashfaq, a case in the First Court of Appeals in Houston that involved two Pakistani individuals who had lived in Texas at one time and had married and divorced in Pakistan. Even though the divorce was filed for and finalized in Pakistan, the ex-wife filed for a divorce a second time in a Texas trial court, and the ex-husband presented the Pakistani divorce decree as defense. The trial court ruled that the divorce decree adequately proved that the couple had divorced in Pakistan, and the court dismissed the request and divided the couple’s assets on the basis that they were already divorced.
The ex-wife then appealed the decision of the court to dismiss the divorce action without, however, contesting the division of the assets. The First Court of Appeals was a three-justice panel of which Justice Massengale was a part, and they upheld the trial court’s decision. It is fairly common for American courts to recognize marriages and divorces from foreign countries, including Muslim nations. This case had nothing to do with Sharia Law. Instead it had everything to do with a court’s decision to recognize a marriage and a divorce in a country in which both parties were citizens. Regardless, the supporters of Massengale’s opponent would not cease using this as a way to attempt to hurt the reputation of a conservative candidate.
Actual Facts Prove Justice Michael Massengale is a Constitutional Conservative
In addition to this, another case that has been used to hurt the reputation of Justice Massengale is the Fountain case in which there was a custody battle between two women who had at one time been in a same-sex relationship. In this case, the ex-girlfriend of the adoptive mother of the child (Ms. Fountain) filed for joint custody of the child. While this case was in court, the two reached an agreement of split custody of the child. The court ruled in favor of the ex-girlfriend and joint custody was officially awarded to both of the parties involved. This case in no way implied that Justice Massengale is pro-homosexual marriage.
However, not considering the actual facts of the case, the Lehrmann supporters have used this case to claim that Justice Massengale is pro-homosexual marriage. This is simply not true; Justice Massengale ruled exactly how the Texas Family Code dictates in such custody situations. According to this section of the law, “a suit can be filed at any time by: a person, other than the foster child, who has had actual care, control, and possession of the child for at least six months not ending more than 90 days preceding the date of the filing of the petition.” This case has nothing to do with marriage or homosexuality. It is simply a custody case. In fact, this case serves as proof of how Justice Massengale strictly interprets the law and rules accordingly, even if it seems to go against his personal beliefs. A true constitutional conservative.
